"GOLD PLUS STAR PRAVAH CONTEST" ("Contest") will be held for STAR PRAVAH ("Channel") as stated hereunder:

1. The Contest shall commence from 2nd April 2009 at 00:00:00 hours and shall end on 25th April 2009 at 23:59:59 hours (Period).

2. The Contest will be pertaining to the program titled "Jodi Jamli Re" ("Program") telecast on the Channel at Thursday - Saturday at 10:00 pm. On air promos shall be telecast on the Channel during the Period which will state the mechanism (manner) in which the viewers have to participate in the Contest.

3. This Contest is only open to the jurisdiction of the state of Maharashtra.

4. Interested participants ("Applicant") must fill up a Contest application form and fill in their detail(s)/answer the question(s) asked in the form.

5. List of stores, where the application form can be availed are:

6. All the entries should state all the required information, which have been asked from Applicant(s). Incomplete/partially filled up entries will not be entertained/considered for the Contest.

7. On the basis of the applications received, SEMPL and/or the Channel shall randomly select the Applicants for auditions and invite them for the same.

8. The selected Applicants shall be informed/contacted by SEMPL and/or the Channel for the purpose of attending the auditions at the contact details provided by the Applicant in the application form. The Company shall make upto five (5) attempts over Three (3) days to contact each of the short listed Applicants and in the event of the Applicant not being reachable in the stipulated timeframe for any reason whatsoever, SEMPL/ the Channel shall have the right to select an alternative Applicant.

9. The time, place and venue of auditions will be informed by SEMPL/ the Channel to the selected Applicants and it is the responsibility of the selected Applicants to be present for the auditions. Failure to be present at the time of audition will automatically disqualify the Applicant from the Contest.

10. All travel and accommodation arrangements for Applicants invited for auditions will be borne and handled by Gold Plus from TATA. However person/relatives (if any) accompanying the Applicants shall bear his/her own costs for travel and accommodation.

11. SEMPL/ the Channel will have the exclusive discretion in the process of selecting the Applicants and calling of selected Applicants for auditions and their audition decision regarding the same shall be final. No dispute with regards to the same shall be entertained.

12. Based on the results of the audition, the selected Applicant(s) ("Contestant") shall be chosen to participate in the Program.

13. The Contestant(s) shall be informed/contacted by SEMPL and/or the Channel at the contact details provided by the Contestant in the application form. The Company shall make upto five (5) attempts over three (3) days to contact each of the short listed Contestants and in the event of the Contestant not being reachable in the stipulated timeframe for any reason whatsoever, SEMPL/ the Channel shall have the right to select an alternative Contestant.

14. SEMPL and/or the Channel reserves the rights to decide the Contestant(s) of the Contest and no further correspondence in this respect shall be entertained.

15. By participating in the Contest, it shall be construed that the Contestant(s) has waived his/her right to raise any dispute with regard to the Contest.

16. All and any other incidental costs direct and/or indirect, in connection with the Contestant(s) participating in the Program, shall be borne by the Contestant(s) and in no manner whatsoever shall the Channel/SEMPL, be responsible for the same.

17. SEMPL and/or the Channel reserves the right to at any time to withdraw the Contest without giving any prior notice thereof to the Contestant(s) or change the timings of telecast of the Program on the Channel.

18. The Contestant(s) shall not raise any dispute with regard to the Contest and/or in any manner whatsoever.

General Rules

1. The Applicant(s), incase of, a female should be eighteen (18) years and above of age, and male should be twenty-one (21) years of age and above. The Applicant(s) (whether a male or a female) needs to be a citizen of India and is resident of India (as per the definition of "resident" in the Income Tax Act, 1961) to qualify for the Contest.

2. The Applicant(s) should not have criminal conviction or an arrangement or a contract that prevents the Applicant from participating in the Contest.

3. Proof of age is a must for the Applicant(s) and must be submitted to the Channel/ SEMPL (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate). All the photocopies pertaining to the supporting documents are to be self-attested.


4. Contestant(s) will submit an affidavit wherein in the marital status of the Contestant(s) shall be stated, i.e., whether the Contestant(s) is married, unmarried, widow, widower, or divorced.

5. Incase the information provided by Contestant(s) is untrue, inaccurate, not current, or incomplete the Company reserves the right to disqualify such a Contestant(s) immediately without any notice. The Company at any given point of time shall not be liable and/or responsible in any manner whatsoever in relation to the information, views, etc. pertaining to the Contestant(s) or any other person who may have shown interest in the Contestant(s).

6. The Company may in its sole discretion exclude a Contestant(s) from participation in the Program which may include without limitation (i) circumstances which, in the Company's view, renders the Contestant(s) unfit to participate therein; (ii) found to be in violation of the rules or undertaking provided to the Company; (iii) inability to submit documentation specified by the Company proving the identity of the Contestant(s).

7. Applicants must enter the Contest on their own behalf and entry(ies) by proxy will not be accepted.

8. The Channel reserves all rights to make amendments to the existing rules without prior notice or withdraw the Contest without giving prior notice in connection thereto. The Applicant(s) shall be solely responsible to check the rules and regulations of this Contest on the website from time to time.

9. Non-conformance by any Contestant(s) of the rules of the Contest will disqualify them from participation, immediately.

10. The Contestant(s) of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or SEMPL and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to them. Further, the Contestant(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Contestant(s) agrees that the footage of any nature with regard to the Contestant(s) shall vest with SEMPL, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

11. The Contestant(s) shall not be entitled for any prize or cash for the opportunity of participation in the Program. If the Contestant(s) refuses to accept the opportunity, the Channel and/or SEMPL shall be released from all obligations towards Contestant(s) in connection to the same. Further, after forfeiting the opportunity, SEMPL and/or the Channel shall be entitled to randomly select and declare another Contestant (s), as it deems fit, and give the opportunity to such Contestant(s).

12. The Contestant (s) agrees that he/she shall not hold SEMPL and/or Channel and/or its employees, responsible for any mishap, accident, injury etc., during travel to and fro from the venue. The Contestant (s) further agrees that he/she shall not hold responsible SEMPL and/or Channel for the foregoing.

13. By participating in the Contest, it shall be deemed to be construed that the Contestant(s) has waived his/her right to dispute in relation to the opportunity of participation so offered to the Contestant(s).

14. By participating in the Contest, it shall be construed that the Contestant(s) has agreed that the Contestant(s) shall hold harmless the Channel, SEMPL, its employees, officers or any other person in relation to any injury/ damage/ harm/ loss suffered by the Contestant(s) in any manner, whatsoever in connection with the Contest and that the Contestant(s) has waived all rights to file in person or through any family member or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or SEMPL to claim any damages or reliefs or otherwise.

15. The Contestant(s) agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or SEMPL, the Contestant (s) is not able to avail the opportunity of participation, the Channel and/or SEMPL cannot be held responsible for the same.

16. The Channel and/or SEMPL is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Contestant(s) in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or the Program.

17. Employees of the Channel and/or SEMPL and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to enter the Contest.

18. Participation of the Contestant(s) in the Contest shall be construed that the Contestant has waived his/her right to dispute any decision(s) made by SEMPL and/or the Channel in connection to the Contest and that the Contestant(s) agrees to all the decision(s) made by SEMPL and/or the Channel. All the decision shall be final and binding upon them.

19. SEMPL and/or the Channel reserve the right to forfeit the opportunity of participation if it is found by SEMPL and/or the Channel that any information provided by the Contestant(s) is wrong or any misrepresentation is made by the Contestant(s). SEMPL or the Channel shall have the right to select another Contestant(s) and give the opportunity to that person.

20. In case the Applicant(s) is found to be in violation by SEMPL and/or the Channel of any and all rules of the Program which includes the rules applicable to selection process, SEMPL/Channel reserves the right to initiate legal proceedings against such person(s) as deemed fit by SEMPL/Channel.

21. The Contestant(s) are required to conduct all necessary due diligence and do background check in relation to the entries or proposals from interested parties/viewers that he/she may receive through the Program. SEMPL/Channel shall not be responsible and/or liable in manner whatsoever.

22. SEMPL/Channel does not support dowry, neither the Contestant(s) nor any of his/her family member can solicit for dowry through the Program. Any Contestant(s) who is found to be interested in dowry and soliciting the same on the Program, SEMPL/Channel reserves the right to delete such performance or participation in the Program.

23. All Contestant(s) shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or SEMPL in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to SEMPL and/or the Channel herein.

24. The participation of the Contestant(s) in the Contest shall mean that the Contestant(s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Contest.

25. The Contestant(s) shall comply with the laws of India.

26. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by SEMPL and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the Contestant(s) who has raised the dispute.

27. Subject to the provision of Clause 26, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim reliefs under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India.
