“STAR PRAVAH SUVASINI SHOW”
SMS CONTEST RULES AND REGULATIONS
“Star Pravah SUVASINI SMS Contest– 2011” (“Contest”) will be held on STAR Pravah (“Channel”) as stated hereunder:
PRINCIPAL TERMS
1. The Contest shall commence from December 07, 2011 at 10:00:00 hours Indian Standard Time ("IST") and shall conclude on December 10, 2011 at 21:30:00 hours IST ("Period"). The contest will be open only for Indian citizens who are resident in Maharashtra.
2. The Contest shall relate to the program titled “Suvasini” which will be telecast on the Channel between December 07, 2011 to December 10, 2011 at 21:00 hours (“Program”). The Channel reserves the rights to change the schedule of the Program without any prior notice to the viewer(s)/ Contestant(s). It shall be the sole responsibility of the viewer(s)/Contestant(s) to check the schedule of the Program.

3. On Air Promos shall be telecast on the Channel during the Period which will state the mechanism (manner) in which the viewers have to participate in the Contest

4. The Contest shall have following question followed by two answer options. The Contestant(s) can provide an answer to the question asked only during the Period and answers provided beyond the Period shall not be eligible for the Contest. The question asked is related to the Program to be telecast on the Channel.
5. The question and options of the answers are as given under:

6. A viewer(s) interested in participating in the Contest should send an SMS to 57827 (“Contestant(s)”). The SMS should contain the keyword SUV followed by followed by the alphabetic answer “YES” OR “NO” which the Contestant(s) believes is the correct answer to the question. Contestant(s) must choose only from the above options of “YES” or “NO”. Viewer(s)/Contestant(s) can log on to www.starpravah.com for the terms & conditions of the Contest.
7. The SMS containing the keyword SUV with the [code(s) OR answer] must be sent by the Contestants(s) to 57827 during the Period only. SMS sent after the Period stated in these terms and conditions shall not be considered and shall be null and void.

8. The cost of the SMS shall be solely borne by the Contestant(s).

9. The Contestant(s) who are subscribers of Vodafone, Aircel, Idea, Reliance Communications, Spice, BSNL, Tata Indicom, Airtel, Reliance Telecom, BPL, MTS, will be charged by their respective mobile operators for each SMS as follows:
Rs. 3: Vodafone, Airtel, BPL, Idea, Reliance Communications, Spice, Aircel, Reliance Telecom, Tata Indicom, MTS
Rs. 2: BSNL (except BSNL West)
Rs. 1: MTNL Mumbai
BSNL West covers Maharashtra, Chattisgarh, Gujarat, Madhya Pradesh and Goa.
10. Neither STAR Entertainment Media Private Limited (“SEMPL”) nor the Channel shall be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS charged by the network operator. Any dispute in connection to the same shall be settled between the Contestant(s) and the network operator directly without any recourse to or involvement of SEMPL or the Channel.

11. In case of telecom and/or network failure and/or for any reasons whatsoever, SEMPL reserves the right to change the mechanism and/or cease from accepting answers of the Contestant(s), or take such necessary steps as it may deem fit, at its sole discretion.
12. All the entries should state all the required information, which have been asked from Contestant(s).
13. It is expressly stated herein that unclear SMS and/or entry/vote, incomplete SMS and/or entry/vote, SMS containing wrong characters, faulty SMS etc. will not be considered and shall be considered as invalid entries.
14. SEMPL and/or the Channel shall randomly select ten (10) winners (“Winner(s)”) among the Contestant(s) who have sent the correct answers to the question asked during Contest pertaining to the Program.

15. The Winner(s) shall be informed/ contacted by SEMPL and/or Channel and/or production house at the phone number from which the answer has been submitted. In the event of the Winner not being reachable for any reason whatsoever, SEMPL/ the Channel shall have the right to select an alternative Winner.

16. SEMPL and/or the Channel reserves the rights to decide the Winner(s) of the Contest.

17. Each Winner will get an opportunity to visit the sets of the Program to meet the lead character “Savitri” of the Program (“Set”) on the date and time as communicated by SEMPL/Channel and/or production house (“Opportunity”).

18. All and any incidental costs direct and/or indirect, in relation to availing the Opportunity shall be borne by the Winner(s) and in no manner whatsoever shall the Channel/SEMPL, be responsible for the same.

19. SEMPL and/or the Channel reserves the right to withdraw at any time the Contest without giving any prior notice thereof to the Contestant(s) or change the date, timings to avail the Opportunity.
General Rules
1. The Contestant(s) should be citizens of India, residing in Maharashtra and must be above the age of 18 years to qualify for the Contest.
2. The Contestant(s) should not have criminal conviction or an arrangement or a contract that prevents the Contestant(s) from participating in the Contest.
3. Proof of age and residence is a must for the Contestant(s) and must be submitted to the Channel/ SEMPL (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).
4. The Winner(s) in whose name the mobile number (from which the message is sent) is registered with a network operator shall be construed to have sent the SMS. Consequently, the Winner(s) in whose name the mobile number (from which the message is sent) is registered with a network operator shall be eligible to avail of the Opportunity.
5. The Winner(s) must submit with SEMPL/Channel a copy of the last two bills issued by the network operator as a proof that the mobile number is registered in the name of the Winner(s) and such other documents that could be furnished as proof that the mobile number is registered in the Winner(s) name.

6. The Channel reserves all rights to make amendments to the existing rules without prior notice or withdraw the Contest without giving prior notice in connection thereto. Non-conformance by any Contestant(s) and/or the Winner(s) of the rules of the Contest will disqualify them from participation or winnings, immediately, as the case may be.
7. The Contestant(s) and the Winner(s) of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or SEMPL and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner(s). Further, the Contestant(s) and the Winner(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Contestant(s) and Winner(s) agrees that the footage of any nature with regard to the Contestant(s) and the Winner(s) shall vest with SEMPL, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

8. The Winner(s) shall not be entitled for any another item or cash equivalent in place and stead of the Opportunity. If the Winner(s) refuses to accept the Opportunity by any act or conduct, or by refusing to avail the same within the time as may be stipulated in this regard or by not reporting at the time or place as may be specified in this respect, the Channel and/or SEMPL shall be released from all obligations towards the Winner(s) in connection to the same. Further, after forfeiting the Opportunity, SEMPL and/or the Channel shall be entitled to randomly select and declare another Winner(s), as it deems fit, and give the Opportunity, to that Winner(s).

9. The Winner(s) shall be responsible to avail the Opportunity on the date, time and venue communicated by SEMPL and/or the Channel and/or production house. The Winner(s) agrees that he/she shall not hold SEMPL and/or Channel and/or its employees, responsible for any mishap, accident, injury etc., during travel to avail the Opportunity. The Winner(s) further agrees that he/she shall not hold responsible SEMPL and/or Channel for the foregoing.

10. By participating in the Contest, it shall be construed that the Contestant(s)/Winner(s) has agreed that the Contestant(s)/Winner(s) shall hold harmless the Channel, SEMPL, its employees, officers or any other person in relation to any trauma/ injury/damage/harm/loss suffered by the Contestant(s) and/or the Winner(s), in any manner, whatsoever in connection with the Contest and/or Opportunity and that the Contestant(s)
11 The Winner(s) agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or SEMPL, the Winner(s) is not able avail the Opportunity, the Channel and/or SEMPL cannot be held responsible for the same.
12 Employees of the Channel, SEMPL, and the members of their immediate family, and/or consultants of and/or persons hired on contract by the Channel, if any and the persons with criminal convictions, persons other than citizens of India and residents of Maharashtra, are ineligible to enter the Contest.
13 The participation of the viewer(s) in the Contest shall mean that the viewer(s)/Contestant(s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Contest.
14 The outcome of the Contest/the decision made by the Channel and/or SEMPL regarding the Contest shall be final and binding on the Contestant(s)/Winner(s) and in no event shall the Contestant(s)/Winner(s) dispute the decision made by SEMPL, Channels and/or its employees in connection to the Contest.
15. SEMPL and/or the Channel reserve the right to forfeit the Opportunity in the event it is found by SEMPL and/or the Channel that any information provided by the Contestant(s) or the Winner(s) is wrong or any misrepresentation is made by the Contestant(s) or the Winner(s). SEMPL or the Channel shall have the right to declare another Contestant(s) as the Winner(s) of the Contest and give the Opportunity to that person.

16. All Contestant(s), the Winner(s), shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or SEMPL in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to SEMPL and/or the Channel herein.

17. The Contestant(s) shall comply with the laws of India.

18. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by SEMPL and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. The costs, charges and expenses in connection to arbitration shall be solely borne by the viewer(s)/Contestant(s)/Winner(s) disputing.
19. Subject to rule 18 above, only the courts in Mumbai shall have the sole and exclusive jurisdiction to decide on any dispute relating to the Contest.
